Terms & Conditions
ACCOMMODATION & RESORT BOOKINGS
These Terms and Conditions (“Terms”) govern all reservations made with Todawaves Luxury Beach Resort & Spa Ltd (“the Resort”). By making payment or confirming a reservation through our website, social media platforms, agents, or direct transfer, you agree to be legally bound by these Terms.
1. RESERVATION & PAYMENT POLICY
1.1 All bookings require 70% full advance payment to be confirmed.
1.2 Reservations are not secured until payment is received and acknowledged by Management.
1.3 Payments may be made via bank transfer, debit/credit card, or approved payment platforms.
1.4 International payments are subject to exchange rate fluctuations and bank processing fees. The Resort shall not be responsible for foreign transaction charges.
1.5 All rates are quoted in Nigerian Naira (₦) unless otherwise stated.
1.6 Payments are strictly non-transferable without written approval from Management.
2. CANCELLATION, MODIFICATION & REFUND POLICY (STRICT)
2.1 Cancellation made 3 days (72 hours) or more before check-in:
• 50% refund only.
2.2 Cancellation made between 24 hours and 72 hours before check-in:
• 30% refund only.
2.3 Cancellation made less than 24 hours before check-in:
• NO REFUND.
2.4 24-HOUR GRACE PERIOD
If a booking is cancelled within 24 hours of payment, and the check-in date is not within 72 hours, a refund may be granted, subject to a 20% administrative processing fee deduction.
This grace period does NOT apply to:
- Same-day bookings
• Promotional or discounted bookings
• Peak season bookings
• Group or event bookings
2.5 No-show guests forfeit 100% of payment.
2.6 Promotional, discounted, holiday, and peak season bookings are strictly NON-REFUNDABLE.
2.7 Refunds (where applicable) will be processed within 14–21 working days via the original payment method only.
2.8 Rescheduling is allowed once only and must be requested at least 72 hours before check-in. New dates must fall within 30 days and are subject to availability.
3. CHECK-IN & CHECK-OUT POLICY
Check-In Time
2:00 PM
- Early check-in before 12:00 PM attracts 50% of room rate (subject to availability).
• Early check-in before 10:00 AM attracts a full-day room rate.
Check-Out Time
12:00 NOON
- Late check-out between 12:00 PM and 3:00 PM incurs 50% of the room rate (subject to availability).
• Late check-out after 3:00 PM attracts a full-day room rate.
• Failure to vacate the room without approval will result in automatic additional billing.
4. ROOM OCCUPANCY POLICY
4.1 Each room accommodates a maximum of two (2) registered guests only unless otherwise stated.
4.2 Any additional guest beyond two (2) persons attracts an extra charge of:
₦150,000 per additional person per night.
4.3 Maximum occupancy limits:
- Loft: Maximum of four (4) persons
• Bungalow: Maximum of three (3) persons
4.4 Under no circumstance shall occupancy exceed these limits.
4.5 All guests must be registered and present valid identification.
4.6 Unauthorized guests or overcrowding may result in:
- Immediate penalty charges
• Deduction from security deposit
• Eviction without refund
5. SECURITY DEPOSIT (CAUTION FEE)
Mandatory at check-in:
- Standard Room – ₦100,000
• Executive/Suite – ₦200,000
• Full Facility – ₦500,000 or as communicated
The deposit covers:
Property damage
• Missing items
• Smoking violations
• Noise disturbances
• Excessive cleaning
• Policy breaches
Refunds (if applicable) will be processed within 24–48 hours after inspection.
6. STRICT NO-SMOKING POLICY
6.1 The Resort operates a strict non-smoking policy in all rooms and enclosed areas.
6.2 Prohibited items include:
- Cigarettes
- Cigars
- Shisha
- Marijuana
- Vapes/E-cigarettes
- Incense
6.3 Violation attracts:
- Minimum penalty of ₦150,000
- Deep cleaning and replacement costs
- Possible eviction without refund
6.4 Tampering with smoke detectors may result in immediate eviction and legal action.
7. GUEST CONDUCT & RESORT RULES
Strictly prohibited:
- Illegal substances
• Violent or disorderly conduct
• Prostitution or immoral activities
• Unauthorized parties
• Excessive noise after 10:00 PM
Management reserves the right to refuse service or evict guests without refund.
8. EVENTS & GROUP BOOKINGS
- Events require prior written approval.
• Additional deposits and event agreements may apply.
• Unauthorized events may result in termination of stay without refund.
9. LIABILITY DISCLAIMER
- Guests are responsible for their personal belongings.
• The Resort is not liable for loss, theft, injury, or force majeure events.
• Use of pool and beach facilities is at the guest’s own risk.
10. CHARGEBACK & FRAUD PROTECTION
Fraudulent chargebacks or payment disputes after service consumption constitute a breach of contract.
The Resort reserves the right to:
- Provide records to financial institutions
• Pursue legal recovery
• Report fraudulent activity
11. GOVERNING LAW
The laws of the Federal Republic of Nigeria govern these Terms.
All disputes shall fall under the exclusive jurisdiction of Nigerian courts
